Camping site City of Cologne General Terms and Conditions (AGB)

Version 2021

1. scope

  • These terms and conditions govern the rights and obligations between the camper and the campsite City of Cologne, Michael Brinkmann and Thomas Schröder GbR, Weidenweg 35, 51105 Cologne.
  • The contractual services of Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR are processed in each case on the basis of the present valid offers, descriptions and price quotations of the price lists valid for the travel period and the campsite regulations in the respective valid version.

2. conclusion of the camping contract

  • Reservations can be made by phone, in person, in writing, by e-mail or online via the Internet form. With the registration, the camper offers the Camping City Cologne Michael Brinkmann and Thomas Schröder GbR the conclusion of a camping contract (pitch rental contract). However, a contractual relationship is only concluded when the booking has been confirmed by Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR in writing or by e-mail and the pitch fees have been paid.
  • With the binding booking confirmation sent to the camper by email by the campsite Stadt Köln Michael Brinkmann und Thomas Schröder GbR, an effective camping contract is concluded between the camper and the campsite. The payment of the pitch fees in the amount of 25% (minimum 25,- Euro) is due within 14 days from receipt of the booking confirmation to the account at Sparkasse KölnBonn:
    IBAN: DE75370501981935596526, BIC: COLSDE33XXX, quoting the invoice number. This is to be verified with regard to the information provided by the camper. The balance of the pitch fees must be paid on the day of arrival. If a booking is made 14 days prior to arrival, the pitch fees must be paid in full upon receipt of the booking confirmation.
  • In case of expiry of the term of payment for the pitch rent without notice, the reservation will be cancelled without separate notification and no effective contract will be concluded.
  • In case of a binding reservation, the arrival must take place on the agreed day of arrival by 10 pm at the latest. Otherwise, unless otherwise agreed, the reservation is forfeited in the event of non-arrival by 10 pm.
  • Space requests will be taken into account at the time of booking if possible. There is no fundamental entitlement to a specific parking space and / or a parking space number. The Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR reserves the right to allocate places depending on the respective booking time. If a rented parking space is not available during the booking period, for whatever reason, claims of the tenant are excluded. The subletting of rented parking spaces is not permitted.
  • Information given by telephone, additional agreements and other assurances of any kind shall only become part of the contract if they have been confirmed in writing by Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR.
  • The reserved pitch/tent is available to the camper from 15:00 on the day of arrival. On the day of departure the place must be vacated in a clean condition by 12:00.
  • Upon termination of the lease, whether by expiration of the rental period or by termination of the lease, the camper shall return the pitch vacated and in a clean condition. Any changes made by the camper, regardless of whether they have been approved by Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR or not, are to be arranged by the camper at his own expense. If the camper does not comply with this obligation despite the setting of a deadline and the threat of substitute performance of the campsite city of Cologne Michael Brinkmann and Thomas Schröder GbR, the campsite city of Cologne Michael Brinkmann and Thomas Schröder GbR is entitled to arrange for substitute performance at the expense of the camper.

3. terms of payment

  • The fees to be paid by the campsite guest result exclusively from the listed costs from the booking confirmation and the respective valid price list of the campsite city of Cologne Michael Brinkmann and Thomas Schröder GbR, which can be found on the homepage of the campsite city of Cologne Michael Brinkmann and Thomas Schröder GbR, camping-koeln.de, as well as can be viewed in the application. With the booking confirmation and the use of the campsite, the campsite guest accepts the current price list, these GTC and the campsite rules, which can be found in the reception and on the homepage of the campsite City of Cologne Michael Brinkmann and Thomas Schröder GbR. The camper has to inform himself about the prices for the offered services valid in the period of registration.
  • Payment for other services must be made in cash, by EC card or by credit card no later than on the day of departure.
  • The camper can withdraw from the camping contract at any time with a corresponding written declaration to the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR. The withdrawal from the camping contract is made by written declaration, either by fax +49 221 4602221 or scanned by e-mail, with signature of the camper. In case of cancellation, Camping City Cologne Michael Brinkmann and Thomas Schröder GbR is entitled to charge the following compensation based on the current price list:
  • Cancellation up to 45 days before the start of the rental period: 25% of the usage fee;
  • Cancellation up to 30 days before the start of the rental period: 50% of the usage fee;
  • Cancellation up to 7 days before the start of the rental period: 80 % of the usage fee.

The camper has the right to prove that the Camping Site City of Cologne Michael Brinkmann and Thomas Schröder GbR has not incurred any damage or that the damage is significantly lower than the agreed lump sum. Cancellations made more than 45 days before the date of arrival are free of charge.

  • In case of later cancellation or early departure, the camper is obliged to pay the pitch rent in full for all booked pitches as indicated in the booking confirmation. The camper has the right to prove that the Camping Site City of Cologne Michael Brinkmann and Thomas Schröder GbR has not incurred any damage or that the damage is significantly lower than the agreed lump sum.
  • The camper is strongly advised to take out private cancellation and/or trip interruption insurance.

4. rental conditions

  • The stay of young people under 18 years of age on the campsite is allowed in principle only in the company of a parent or guardian or an adult to whom the parental rights and duties and responsibility have been transferred by the parent(s). The written consent form, including a copy of the identity card, must be presented by the young person’s legal guardian(s) at the time of registration at the campsite without being asked.
  • The pitch may be used by the maximum number of people who have registered. The camper who has made the booking is personally liable for all obligations arising from the concluded contract, including the persons registered by him. Visitors of the tenant / tenant must be announced before entering the campsite.
  • The campsite guest is generally obliged to good behavior, observance of the cleanliness of the pitch as well as the campsite in general, observance of the quiet hours and avoidance of disturbing noise. Further details are regulated by the campsite regulations, which are part of the contract in their current version.   • If defects or deficiencies occur, the camper is obligated to inform the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR immediately.

5. terms of use

  • Use of the parking spaces and the caravans, mobile homes and tents set up there for longer-term residential purposes is not permitted – without special agreement.
  • If the camper operates a gas system in his caravan/motor home, a valid test certificate for liquid gas systems in vehicles and/or tents awnings must be presented before the start of the rental period. Likewise, the camper is responsible at his own expense for the proper and timely performance of the gas check (G 607 test guideline Germany). If the camper does not comply with this obligation, the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is entitled to put the facility out of operation in order not to endanger other campers.
  • The camper undertakes to keep the rented pitch, including the caravan or motorhome parked there, clean and in perfect condition at all times.
  • Parking of cars is only permitted on the spaces allocated for this purpose by Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR. Passenger cars and other motor vehicles may not be parked in any unoccupied parking spaces. Additional camping equipment and vehicles require the approval of the reception staff from the campsite and must be registered.
  • Any transfer of use to third parties, in particular the renting or leasing of the areas provided or private camping and recreation facilities (tents, caravans) is strictly prohibited. Exceptions require the written permission of the campsite operator.
  • There is limited parking available directly at the campsite. The Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR assumes no liability for possible damage or theft of the vehicles.

6. power supply

  • Electricity is supplied only to tenants / leaseholders who, as consumers, comply with all VDE regulations. The power connection is considered to be an electrical outlet. The power is transferred at the power box.

7. wifi / internet supply

  • For Internet use via W-LAN, the campsite city Cologne Michael Brinkmann and Thomas Schröder GbR has concluded a supply contract for the campsite area with Telekom Deutschland GmbH, 53171 Bonn.
  • The technical equipment for the internet supply installed on the campsite premises may not be entered or altered without authorization.
  • For technical reasons, no specific transmission speed can be guaranteed, as this also depends on the number of users of the respective HotSpot.
  • The wireless connection between the HotSpot and the end device of the camper is unencrypted. It can therefore not be ruled out that other persons gain access to the transmitted data. The customer is responsible for encrypting the data himself.
  • There is no liability for damages that may occur through the use of the HotSpot. The camper is responsible for sufficient virus protection, data backup etc..
  • The campsite guest is responsible for the content he/she retrieves or provides from the Internet via the HotSpot. A contentwise examination by the offerer or the camping site city Cologne Michael Brinkmann and Thomas Schröder GbR does not take place.
  • Misuse of the HotSpot is prohibited, in particular
    • the dissemination of illegal or immoral content,
    • the use of peer-to-peer networks,
    • the attempt to penetrate foreign data networks,
    • the unsolicited sending of messages (spamming),
    • Use equipment or run applications that cause or may cause interference / changes to the physical or logical structure of the HotSpot server, the HotSpot network or other networks.

In case of culpable violation, the camper is liable for damages.

8. environment and nature conservation

  • The campsite of the city of Cologne Michael Brinkmann and Thomas Schröder GbR is a campsite located in a nature reserve. For this reason, any interference with the natural state of the campsite is strictly prohibited. Neither structures of any kind may be erected, nor ground corrections made, plants pruned or dug up, trees, branches or shrubs cut or shortened, etc. Barriers are generally not permitted.
  • Open fire is prohibited on the entire premises. Barbecuing without an open fire is generally allowed at the campsite Stadt Köln Michael Brinkmann und Thomas Schröder GbR. Further details are regulated by the campsite regulations.

9. authority to issue instructions

  • The campsite operator has the domiciliary rights. Further details are regulated by the campsite regulations.

10. termination of the camping contract

  • Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is entitled to withdraw from the camping contract if the respective pitch cannot be made available after conclusion of the contract due to force majeure (in particular due to flooding). In this case, the campsite owner is obliged to inform the camper immediately about the unavailability of the rental object. In this case, any amounts paid will be refunded to the camper. However, further claims of the camper beyond this are excluded.
  • The Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is entitled to terminate the contract without notice for good cause if the campsite guest persistently violates the camping contract or the camping rules through his behavior, endangers others, causes repeated disturbances, makes use of the pitch or the rental object contrary to the contract or behaves in any other way contrary to the contract. In this case, the camper must pay the entire rental price agreed with the campsite owner. In this case, claims for compensation by the camper are excluded.
  • If the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR has terminated the contract with the camper without notice, the camper has to leave the rented pitches himself and also the campsite itself immediately.

11. liability of the camper, his companions and visitors

  • The campsite guest and the persons accompanying him undertake to treat the rented pitch as well as all buildings, facilities, inventory of the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR with care. The campsite guest is liable for damages to the rented pitch as well as to the facilities and equipment of the campsite, as far as they have been caused by him or the persons belonging to his household, his visitors etc.. The damage caused by the camper must be reported immediately to the reception.
  • If the camper pays damages, the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is obliged to assign to the camper any claims against the person who caused the damage.

12. limitation of liability of Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR

  • The Camping Site City Cologne Michael Brinkmann and Thomas Schröder GbR assumes no liability for damages, accidents, losses or other irregularities that occur in connection with the use of the entire camping site. Claims of the camper for damages are therefore excluded in principle.
  • The Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is only liable for damages caused by intent or gross negligence in the context of a breach of duty. This also applies to breaches of duty by legal representatives or vicarious agents of Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR.
  • In particular, the Camping City Cologne Michael Brinkmann and Thomas Schröder GbR is not liable for damages caused by the failure or disruption of water, electricity, gas and / or Internet supply, as well as noise pollution by third parties.
  • Furthermore, the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is not liable in case of slightly negligent breaches of duty for damages caused by the use of the facilities or equipment located on the campsite.
  • The aforementioned limitation of liability shall not apply, however, if liability is assumed on the basis of statutory provisions due to injury to life, limb or health.
  • Bathing in the Rhine is not allowed and – if it is done – at your own risk. Any liability for damages caused thereby, whether personal injury or property damage of any kind, is excluded.
  • The Camping Site City Cologne Michael Brinkmann and Thomas Schröder GbR expressly points out within the scope of liability that irregularities, damages or losses resulting from nature and the environment, for example due to branches, insects, other wild animals, weather conditions can occur. Liability for damages caused by this as well as by force majeure is excluded.

13. data protection

  • The camper agrees that Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR may store all information regarding the contractual relationship and the details of the contract in an electronic data processing system and use it for the purpose of contract execution and billing. A communication of the stored data to external third parties does not take place.

14. photo shootings

  • Photo and film works are carried out at the campsite at irregular intervals. As soon as this should be the case, you will be asked to document your consent or rejection, as the case may be, in writing.

15. additional notes

  • Changes and amendments to the contracts concluded with Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR must be made in writing. The law of the Federal Republic of Germany shall apply between the camper and the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR. The exclusive place of jurisdiction for all disputes arising from the contract is Cologne. The camper confirms that the personal data are correct. The campsite guest accepts these GTC including the site regulations by paying the usage fees.
  • A set-off of claims of the campsite guest is only permissible insofar as this is undisputed or legally established.
  • In addition, the valid state ordinance on camping and weekend sites of the state of North Rhine-Westphalia applies, which can be viewed at any time in the reception.

16. alternative dispute resolution pursuant to Art. 14 para. 1 ODR Regulation and § 36 VSBG

  • The European Commission provides a platform for online dispute resolution (OS), which you can find at httpsp://ec.europa.eu/consumers/odr/.
  • The Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR is not obliged to participate in a dispute resolution procedure before a consumer arbitration board.

17. changes to the homepage and prospectus information

  • Only the prices and dates stated in the booking confirmation are binding. The information and prices in brochures correspond to the status at the time of printing. However, please understand that prices and services may change for factual reasons (e.g. energy supply, increase in mineral oil tax, increase in value added tax or other taxes and duties, etc.) until your booking request is submitted.

18. severability clause

  • Should individual provisions of the General Terms and Conditions of the Campingplatz Stadt Köln Michael Brinkmann und Thomas Schröder GbR be invalid, unenforceable or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining provisions of these General Terms and Conditions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the valid or enforceable provision that most closely approximates the effects of the economic objective pursued by the contracting parties with the invalid or unenforceable provision.
  • The above provisions shall apply mutatis mutandis in the event that the contract proves to be incomplete.
